The San Bernardino County District Attorney’s Office has filed charges against John Robert Griffin (Age 27 of Yucca Valley) for child abuse in Yucca Valley.


CASE SYNOPSIS

On Tuesday, March 23, 2021, deputies from the San Bernardino County Sheriff’s Department responded to the intersection of Joshua Lane and Onaga Trail in Yucca Valley regarding a traffic collision. During the investigation, John Robert Griffin was arrested.

After reviewing this case, our office has filed charges against Mr. Griffin for violating the following sections of the California Penal Code and California Vehicle Code:

Penal Code Section 273a(a) – Child Abuse Under Circumstances Or Conditions Likely To Cause GBI Or Death (Felony)
Any person who, under circumstances or conditions likely to produce great bodily harm or death, willfully causes or permits any child to suffer, or inflicts thereon unjustifiable physical pain or mental suffering, or having the care or custody of any child, willfully causes or permits the person or health of that child to be injured, or willfully causes or permits that child to be placed in a situation where his or her person or health is endangered, shall be punished by imprisonment in a county jail not exceeding one year, or in the state prison for two, four, or six years.

Vehicle Code Section 23152(a) – Driving Under The Influence Of An Alcoholic Beverage (Misdemeanor)
It is unlawful for a person who is under the influence of any alcoholic beverage to drive a vehicle.

Vehicle Code Section 23152(b) – Driving With A .08% Blood Alcohol Content (Misdemeanor)
It is unlawful for a person who has 0.08 percent or more, by weight, of alcohol in his or her blood to drive a vehicle.

For purposes of this article and Section 34501.16, percent, by weight, of alcohol in a person’s blood is based upon grams of alcohol per 100 milliliters of blood or grams of alcohol per 210 liters of breath.

In any prosecution under this subdivision, it is a rebuttable presumption that the person had 0.08 percent or more, by weight, of alcohol in his or her blood at the time of driving the vehicle if the person had 0.08 percent or more, by weight, of alcohol in his or her blood at the time of the performance of a chemical test within three hours after the driving.
