The San Bernardino County District Attorney’s Office has charged Mose Marquelius Thomas (Age 34 of Rialto) with multiple firearms charges.


CASE SYNOPSIS

On Monday, December 21, 2020, the Fontana Police Department completed a shooting investigation in the 16900 block of San Bernardino Avenue, in Fontana. During the investigation, Mose Marquelius Thomas was arrested.

After reviewing this case, our office has charged Mr. Thomas with violating the following sections of the California Penal Code:

Penal Code Section 246.3(a) – Discharge of Firearm With Gross Negligence (Felony)
Except as otherwise authorized by law, any person who willfully discharges a firearm in a grossly negligent manner which could result in injury or death to a person is guilty of a public offense and shall be punished by imprisonment in a county jail not exceeding one year, or by imprisonment pursuant to subdivision (h) of Section 1170.

Penal Code Section 29800(a)(1) – Possession of A Firearm By A Felon (Felony)
Any person who has been convicted of a felony under the laws of the United States, the State of California, or any other state, government, or country, or of an offense enumerated in subdivision (a), (b), or (d) of Section 23515, or who is addicted to the use of any narcotic drug, and who owns, purchases, receives, or has in possession or under custody or control any firearm is guilty of a felony.

Penal Code Section 30305(a)(1) – Unlawful Possession of Ammunition (Felony)
No person prohibited from owning or possessing a firearm under Chapter 2 (commencing with Section 29800) or Chapter 3 (commencing with Section 29900) of Division 9 of this title, or Section 8100 or 8103 of the Welfare and Institutions Code, shall own, possess, or have under custody or control, any ammunition or reloaded ammunition.
