The San Bernardino County District Attorney’s Office has filed charges against Shawn Michell Monaco (Age 43 of Riverton, Utah) for murder in Rialto.


CASE SYNOPSIS

On Friday, November 9, 2018 officers from the Rialto Police Department responded to a call of shots being fired in the 200 block of West Foothill Boulevard in Rialto. During the investigation, Shawn Michell Monaco was identified as a person of interest. The investigation continued for nearly two years until detectives gathered enough probable cause to issue an arrest warrant for Mr. Monaco.

On Tuesday, August 18, 2020, special agents with the United States Marshals Service – Regional Fugitive Task Force located Mr. Monaco at his place of work in Utah. Mr. Monaco was arrested and escorted back to San Bernardino County.

After reviewing this case, our office has charged Mr. Monaco in violation of the following sections of the California Penal Code:

Penal Code Section 187(a) – Murder (Felony)
Murder is the unlawful killing of a human being, or a fetus, with malice aforethought.

Penal Code Section 246 – Shooting At An Inhabited Dwelling/Occupied Motor Vehicle/Occupied Aircraft/ETC(Felony)
Any person who shall maliciously and willfully discharge a firearm at an inhabited dwelling house, occupied building, occupied motor vehicle, occupied aircraft, inhabited housecar, as defined in Section 362 of the Vehicle Code, or inhabited camper, as defined in Section 243 of the Vehicle Code, is guilty of a felony, and upon conviction shall be punished by imprisonment in the state prison for three, five, or seven years, or by imprisonment in the county jail for a term of not less than six months and not exceeding one year.

As used in this section, “inhabited” means currently being used for dwelling purposes, whether occupied or not.

Penal Code Section 29800(a)(1) – Possession Of Firearm By A Felon (Felony)
Any person who has been convicted of, or has an outstanding warrant for, a felony under the laws of the United States, the State of California, or any other state, government, or country, or of an offense enumerated in subdivision (a), (b), or (d) of Section 23515, or who is addicted to the use of any narcotic drug, and who owns, purchases, receives, or has in possession or under custody or control any firearm is guilty of a felony.

Penal Code Section 30305(a)(1) – Unlawful Possession Of Ammunition (Felony)
No person prohibited from owning or possessing a firearm under Chapter 2 (commencing with Section 29800) or Chapter 3 (commencing with Section 29900) of Division 9 of this title, or Section 8100 or 8103 of the Welfare and Institutions Code, shall own, possess, or have under custody or control, any ammunition or reloaded ammunition.
