The San Bernardino County District Attorney’s Office has filed charges against Robert Anthony Garcia (Age 25 of San Bernardino) for carjacking and other crimes in Apple Valley.


CASE SYNOPSIS

On Friday, January 8, 2021, deputies from the San Bernardino County Sheriff’s Department responded to the 12000 block of Standing Bear Road in Apple Valley regarding a carjacking. During the investigation, Robert Anthony Garcia was arrested.

After reviewing this case, our office has filed charges against Mr. Garcia, for violating the following sections of the California Penal Code:

Penal Code Section 215(a) – Carjacking (Felony)
“Carjacking” is the felonious taking of a motor vehicle in the possession of another, from his or her person or immediate presence, or from the person or immediate presence of a passenger of the motor vehicle, against his or her will and with the intent to either permanently or temporarily deprive the person in possession of the motor vehicle of his or her possession, accomplished by means of force or fear.

Penal Code Section 29800(a)(1) – Possession Of Firearm By A Felon (Felony)
Any person who has been convicted of a felony under the laws of the United States, the State of California, or any other state, government, or country, or of an offense enumerated in subdivision (a), (b), or (d) of Section 23515, or who is addicted to the use of any narcotic drug, and who owns, purchases, receives, or has in possession or under custody or control any firearm is guilty of a felony.

Penal Code Section 136.1(b)(1) – Dissuading A Witness From Reporting A Crime (Felony)
(b) Except as provided in subdivision (c), every person who attempts to prevent or dissuade another person who has been the victim of a crime or who is witness to a crime from doing any of the following is guilty of a public offense and shall be punished by imprisonment in a county jail for not more than one year or in the state prison:
(1) Making any report of that victimization to any peace officer or state or local law enforcement officer or probation or parole or correctional officer or prosecuting agency or to any judge.

Penal Code Section 422(a) – Criminal Threats (Felony)
Any person who willfully threatens to commit a crime which will result in death or great bodily injury to another person, with the specific intent that the statement, made verbally, in writing, or by means of an electronic communication device, is to be taken as a threat, even if there is no intent of actually carrying it out, which, on its face and under the circumstances in which it is made, is so unequivocal, unconditional, immediate, and specific as to convey to the person threatened, a gravity of purpose and an immediate prospect of execution of the threat, and thereby causes that person reasonably to be in sustained fear for his or her own safety or for his or her immediate family’s safety, shall be punished by imprisonment in the county jail not to exceed one year, or by imprisonment in the state prison.

Penal Code Section 646.9(a) – Stalking With Temporary Restraining Order/ Injunction In Effect (Felony)
Any person who willfully, maliciously, and repeatedly follows or willfully and maliciously harasses another person and who makes a credible threat with the intent to place that person in reasonable fear for his or her safety, or the safety of his or her immediate family is guilty of the crime of stalking, punishable by imprisonment in a county jail for not more than one year, or by a fine of not more than one thousand dollars ($1,000), or by both that fine and imprisonment, or by imprisonment in the state prison.
