The San Bernardino County District Attorney’s Office has filed charges against Nicole Rachel Packer (Age 34 of Morongo Valley) for killing two teenagers while driving under the influence.


CASE SYNOPSIS

On Wednesday, June 12, 2019, at about 2230 hours, a traffic collision occurred on Highway 62 in the unincorporated community of Morongo Valley. An extensive investigation was completed by the California Highway Patrol’s Major Accident Investigation Team. Killed in the collision was a 14-year-old and a 17-year-old.

After reviewing this case, our office has charged the driver of one of the vehicles, Ms. Packer, for violating the following sections of the California Penal Code and California Vehicle Code:

Penal Code Section 187(a) – Murder (Felony)
Murder is the unlawful killing of a human being, or a fetus, with malice aforethought.

Vehicle Code Section 23153(a) – Driving Under The Influence Causing Injury With A Prior Conviction (Felony)
It is unlawful for a person, while under the influence of any alcoholic beverage, to drive a vehicle and concurrently do any act forbidden by law, or neglect any duty imposed by law in driving the vehicle, which act or neglect proximately causes bodily injury to any person other than the driver.

Vehicle Code Section 23153(b) – .08% Blood Alcohol Content Causing Injury With Prior Conviction (Felony)
It is unlawful for a person, while having 0.08 percent or more, by weight, of alcohol in his or her blood to drive a vehicle and concurrently do any act forbidden by law, or neglect any duty imposed by law in driving the vehicle, which act or neglect proximately causes bodily injury to any person other than the driver.

Vehicle Code Section 23153(g) Driving While Under Combined Influence of Alcohol and Drug With Prior Conviction Causing Injury (Felony)
It is unlawful for a person, while under the combined influence of any alcoholic beverage and drug, to drive a vehicle and concurrently do any act forbidden by law, or neglect any duty imposed by law in driving the vehicle, which act or neglect proximately causes bodily injury to any person other than the driver.

Vehicle Code Section 14601.1(a) – Driving With A Suspended License (Misdemeanor)
No person shall drive a motor vehicle when his or her driving privilege is suspended or revoked for any reason other than those listed in Section 14601, 14601.2, or 14601.5, if the person so driving has knowledge of the suspension or revocation. Knowledge shall be conclusively presumed if mailed notice has been given by the department to the person pursuant to Section 13106. The presumption established by this subdivision is a presumption affecting the burden of proof.
