The San Bernardino County District Attorney’s Office has charged Gabriel Leon (Age 22 of Apple Valley, CA) and Patricia Francine Gonzalez (Age 52 of Apple Valley, CA) with the murder of Jacqueline Amour Hernandez.
CASE SYNOPSIS
On Wednesday, October 7, 2020, the San Bernardino County Sheriff’s Department investigated the death of Jacqueline Amour Hernandez, who was found in the desert on Japatul Road and Power Line Road in Lucerne Valley. During their investigation, detectives found that the victim lived with the two suspects at a residence in the 18900 block of Shetland Road in Apple Valley. Mr. Leon and Ms. Gonzalez were arrested.
After reviewing this case, our office has charged Mr. Leon with violating the following sections of the California Penal Code:
Penal Code Section 187(a) – Murder (Felony)
Murder is the unlawful killing of a human being, or a fetus, with malice aforethought.
Penal Code Section 273.5(a) – Injuring a Spouse, Cohabitant, Fiancé, Boyfriend, Girlfriend or Child’s Parent (Felony)
Any person who willfully inflicts corporal injury resulting in a traumatic condition upon a victim described in subdivision (b) is guilty of a felony, and upon conviction thereof shall be punished by imprisonment in the state prison for two, three, or four years, or in a county jail for not more than one year, or by a fine of up to six thousand dollars ($6,000), or by both that fine and imprisonment.
Penal Code Section 236 – False Imprisonment by Violence (Felony)
False imprisonment is the unlawful violation of the personal liberty of another.
Penal Code Section 136.1(b)(1) – Dissuading a Witness From Reporting a Crime (Misdemeanor)
Except as provided in subdivision (c), every person who attempts to prevent or dissuade another person who has been the victim of a crime or who is witness to a crime from doing any of the following is guilty of a public offense and shall be punished by imprisonment in a county jail for not more than one year or in the state prison: (1) Making any report of that victimization to any peace officer or state or local law enforcement officer or probation or parole or correctional officer or prosecuting agency or to any judge.
Penal Code Section 243(e)(1) – Battery on a Spouse, Cohabitant, Fiancé, Boyfriend, Girlfriend or Child’s Parent (Misdemeanor)
When a battery is committed against a spouse, a person with whom the defendant is cohabiting, a person who is the parent of the defendant’s child, former spouse, fiancé, or fiancée, or a person with whom the defendant currently has, or has previously had, a dating or engagement relationship, the battery is punishable by a fine not exceeding two thousand dollars ($2,000), or by imprisonment in a county jail for a period of not more than one year, or by both that fine and imprisonment. If probation is granted, or the execution or imposition of the sentence is suspended, it shall be a condition thereof that the defendant participate in, for no less than one year, and successfully complete, a batterer’s treatment program, as described in Section 1203.097, or if none is available, another appropriate counseling program designated by the court. However, this provision shall not be construed as requiring a city, a county, or a city and county to provide a new program or higher level of service as contemplated by Section 6 of Article XIII B of the California Constitution
In addition, our office has charged Ms. Gonzalez with violating the following section of the California Penal Code:
Penal Code Section 32 – Knowledge of Crime (Felony)
Every person who, after a felony has been committed, harbors, conceals or aids a principal in such felony, with the intent that said principal may avoid or escape from arrest, trial, conviction or punishment, having knowledge that said principal has committed such felony or has been charged with such felony or convicted thereof, is an accessory to such felony.
