The San Bernardino County District Attorney’s Office has filed charges against James Russell Allen II (Age 43 of Victorville) for rape and other crimes in Colton.
CASE SYNOPSIS
On Wednesday, January 22, 2020, officers from the Colton Police Department responded to the 600 block in North Cadena Drive in Colton regarding a rape. During the investigation, James Russell Allen II was arrested.
After reviewing this case, our office has filed charges against Mr. Allen for violating the following sections of the California Penal Code:
Penal Code Section 289(a)(1)(C) – Sexual Penetration By Use Of Force Of Minor Victim Over 14 (Felony/ MISDO)
Any person who commits an act of sexual penetration upon a minor who is 14 years of age or older, when the act is accomplished against the victim’s will by means of force, violence, duress, menace, or fear of immediate and unlawful bodily injury on the victim or another person, shall be punished by imprisonment in the state prison for 6, 8, or 10 years.

Penal Code Section 261(a)(2) – Forcible Rape – Child Victim Over 14 Years (Felony)
Where it is accomplished against a person’s will by means of force, violence, duress, menace, or fear of immediate and unlawful bodily injury on the person or another.

Penal Code Section 287(c)(2)(C) – Forcible Oral Copulation – Minor Victim Over 14 Years
Any person who commits an act of oral copulation upon a minor who is 14 years of age or older, when the act is accomplished against the victim’s will by means of force, violence, duress, menace, or fear of immediate and unlawful bodily injury on the victim or another person, shall be punished by imprisonment in the state prison for 6, 8, or 10 years.

Penal Code Section 273.5(a) – Corporal Injury To Spouse/ Cohabitant/ Child’s Parent (Misdemeanor)
Any person who willfully inflicts corporal injury resulting in a traumatic condition upon a victim described in subdivision (b) is guilty of a felony, and upon conviction thereof shall be punished by imprisonment in the state prison for two, three, or four years, or in a county jail for not more than one year, or by a fine of up to six thousand dollars ($6,000), or by both that fine and imprisonment.
