The San Bernardino County District Attorney’s Office has filed charges against Andre Demonde Love (Age 33 of San Bernardino) for evading an officer and other crimes in San Bernardino.
CASE SYNOPSIS
On Sunday, February 21, 2021, a deputy from the San Bernardino County Sheriff’s Department attempted to stop a vehicle. After the vehicle failed to stop, a pursuit occurred. After crashing his vehicle at East 3rd St & Shirley Avenue in San Bernardino, Andre Demonde Love was arrested.
After reviewing this case, our office has filed charges against Mr. Love for violating the following sections of the California Penal Code, the California Vehicle Code, and the California Health and Safety Code:
Penal Code Section 29800(a)(1) – Possession Of Firearm By A Felon (Felony)
Any person who has been convicted of a felony under the laws of the United States, the State of California, or any other state, government, or country, or of an offense enumerated in subdivision (a), (b), or (d) of Section 23515, or who is addicted to the use of any narcotic drug, and who owns, purchases, receives, or has in possession or under custody or control any firearm is guilty of a felony.
Vehicle Code Section 2800.2(a) – Evading An Officer, Willful Disregard (Felony)
If a person flees or attempts to elude a pursuing peace officer in violation of Section 2800.1 and the pursued vehicle is driven in a willful or wanton disregard for the safety of persons or property, the person driving the vehicle, upon conviction, shall be punished by imprisonment in the state prison, or by confinement in the county jail for not less than six months nor more than one year. The court may also impose a fine of not less than one thousand dollars ($1,000) nor more than ten thousand dollars ($10,000), or may impose both that imprisonment or confinement and fine.
Health and Safety Code 11370.1(a) – Possession Of A Controlled Substance With Firearm (Felony)
Notwithstanding Section 11350 or 11377 or any other provision of law, every person who unlawfully possesses any amount of a substance containing cocaine base, a substance containing cocaine, a substance containing heroin, a substance containing methamphetamine, a crystalline substance containing phencyclidine, a liquid substance containing phencyclidine, plant material containing phencyclidine, or a hand-rolled cigarette treated with phencyclidine while armed with a loaded, operable firearm is guilty of a felony punishable by imprisonment in the state prison for two, three, or four years.
As used in this subdivision, “armed with” means having available for immediate offensive or defensive use.
