The San Bernardino County District Attorney’s Office has filed charges against Ashley Darlene Kelly (Age 32 of San Bernardino) for identity theft and other crimes in Rancho Cucamonga.


CASE SYNOPSIS

On Tuesday, December 29, 2020, deputies from the San Bernardino County Sheriff’s Department investigated a case of identity theft. During the investigation, Ashley Darlene Kelly was arrested.

After reviewing this case, our office has filed charges against Ms. Kelly for violating the following sections of the California Penal Code and the Unemployment Insurance Code:

Penal Code Section 530.5(a) – Identity Theft (Felony)
Every person who willfully obtains personal identifying information, as defined in subdivision (b) of Section 530.55, of another person, and uses that information for any unlawful purpose, including to obtain, or attempt to obtain, credit, goods, services, real property, or medical information without the consent of that person, is guilty of a public offense, and upon conviction therefor, shall be punished by a fine, by imprisonment in a county jail not to exceed one year, or by both a fine and imprisonment, or by imprisonment pursuant to subdivision (h) of Section 1170.

Penal Code Section 484e(d) – Grand Theft Of Access Card Account Information (Felony)
Every person who acquires or retains possession of access card account information with respect to an access card validly issued to another person, without the cardholder’s or issuer’s consent, with the intent to use it fraudulently, is guilty of grand theft.

Unemployment Insurance Code 2101(a) – False Statement, Representation Or Concealment (Felony)
It is a violation of this chapter to willfully make a false statement or representation, to knowingly fail to disclose a material fact, or to use a false name, false social security number, or other false identification to obtain, increase, reduce, or defeat any benefit or payment, whether for the maker or for any other person, under any of the following statutes administered by the department:
(1) The provisions of this division.
(2) The provisions of any unemployment insurance law of the federal government.
(3) The provisions of any training allowance law of the federal government.
(4) The provisions of any trade readjustment allowance law of the federal government.
(5) The provisions of any other allowance law of the federal government
