The San Bernardino County District Attorney’s Office has charged Almirante Perez (Age 43 of Highland) with workers’ compensation fraud and other charges in San Bernardino.


CASE INFORMATION

The California Department of Insurance completed an investigation in which Almirante Perez had committed several violations of the California Insurance Code.

After reviewing this case, our office has filed charges against Mr. Perez for violation of the following sections of the California Insurance Code:

Insurance Code Section 11760(a) – Workers’ Compensation Fraud (Felony)
It is unlawful to make or cause to be made any knowingly false or fraudulent statement, whether made orally or in writing, of any fact material to the determination of the premium, rate, or cost of any policy of workers’ compensation insurance, for the purpose of reducing the premium, rate, or cost of the insurance. Any person convicted of violating this subdivision shall be punished by imprisonment in a county jail for one year, or pursuant to subdivision (h) of Section 1170 of the Penal Code for two, three, or five years, or by a fine not exceeding fifty thousand dollars ($50,000), or double the value of the fraud, whichever is greater, or by both that imprisonment and fine.

Unemployment Insurance Code Section 2118.5 – Tax Evasion (Felony)
Any person required by this code to collect, account for, and pay over any tax or amount required to be withheld who willfully fails to collect or truthfully account for and pay over the tax or amount shall, in addition to other penalties provided by law, be guilty of a felony and, upon conviction thereof, shall be fined an amount not more than twenty thousand dollars ($20,000), or imprisoned in the state prison, or both the fine and imprisonment, at the discretion of the court.
