The San Bernardino County District Attorney’s Office has charged Andres Ballesteros Medina (Age 41 of Rialto), Michael Anthony Nunez (Age 33 of San Bernardino), and Gilbert Lee Nunez (Age 37 – no city listed) with crimes related to an unlawful assembly in Yucaipa.


CASE SYNOPSIS

On Saturday, August 1, 2020, a protest occurred in the city of Yucaipa, on Yucaipa Boulevard. When the protest became volatile, the San Bernardino County Sheriff’s Department declared it an unlawful assembly. Several people were arrested, to include Andres Ballesteros Medina, Michael Anthony Nunez, and Gilbert Lee Nunez.

After reviewing this case, our office has charged Medina with violating the following section of the California Penal Code:

Penal Code Section 245(c) – Assault Upon A Peace Officer or Firefighter
Any person who commits an assault with a deadly weapon or instrument, other than a firearm, or by any means likely to produce great bodily injury upon the person of a peace officer or firefighter, and who knows or reasonably should know that the victim is a peace officer or firefighter engaged in the performance of his or her duties, when the peace officer or firefighter is engaged in the performance of his or her duties, shall be punished by imprisonment in the state prison for three, four, or five years.

Medina, Michael Anthony Nunez and Gilbert Lee Nunez are also charged with violating the following section of the California Penal Code:

Penal Code Section 22210 – Possession Of A Billy, Blackjack, ETC.
Except as provided in Section 22215 and Chapter 1 (commencing with Section 17700) of Division 2 of Title 2, any person in this state who manufactures or causes to be manufactured, imports into the state, keeps for sale, or offers or exposes for sale, or who gives, lends, or possesses any leaded cane, or any instrument or weapon of the kind commonly known as a billy, blackjack, sandbag, sandclub, sap, or slungshot, is punishable by imprisonment in a county jail not exceeding one year or imprisonment pursuant to subdivision (h) of Section 1170.
